So here´s a bit of a touchy subject: what happens to your newly purchased Spanish property if you get hit by a bus tomorrow? Spanish laws says that the ownership of the property is transferred to your spouse, or, if you don't have a spouse, then it´s shared equally between your children. If you have no spouse or children, well, things can get complicated, and it´s best to have a quick discussion with your Spanish property attorney.

Home and Help recommends that you, not wait, but take care of the question of whom to bequeath your Spanish property to at the time of purchase. You (or someone on your behalf) will be at the notary anyway, so it would be just one more paper to sign. All that is needed is a Spanish will, or, as they called it, "Testamento Abierto." Your Spanish property attorney will be able to communicate your wishes to the notary so that the document will be prepared correctly.
