THE NOTARY
The notary official´s key responsibility is to ensure that the conveyance deed is written correctly, that the seller has received the agreed-upon purchase price, and that all of the appropriate fees and taxes being collected. Upon completion, you and the seller will sign the deed and the notary official will endorse it as a witness. Next, the notary´s office will send the deed to the Spanish Land Registry Office, listing you as the new owner. You (or your mortgage lender) will get the original title deed back once the Land Registry Office processes it, but this may take some time; after all, this is Spain! However, in the meantime, you´ll get an official copy. The good news here is that you don´t even have to be present for any of this. You can authorize an agent to go to the notary for you and sign the documents on your behalf. The authorization comes in the form of a document called an ´Escritura de Poder de Compraventa´ (Special Power of Attorney). This is usually drawn up once you´ve agreed on a purchase.
